Docvaya Terms of Service

These Terms govern your use of the Docvaya mobile app ("the App"), developed and published by Parshva Web Solutions, Goa, India ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

1. Licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for lawful personal or business purposes, in line with these Terms and the rules of the store you downloaded it from. You may not copy, modify, reverse engineer, resell or redistribute the App, except where the law expressly allows it.

2. Your content

Everything you scan, import or create in the App ("your content") remains yours. Because the App processes and stores your content on your device, we do not receive, own or claim any rights to it. You are responsible for having the right to scan, copy and share the documents you use with the App.

3. Acceptable use

You agree not to use the App to:

• forge, alter or misrepresent identity documents, certificates, currency, cheques, stamps or signatures;
• copy or distribute material in breach of copyright or other rights;
• scan or share another person's documents or personal data without a lawful basis;
• break any law that applies to you.

4. Free and Premium features

Core scanning, editing, text recognition, library and export features are free. Some features ("Premium") need a paid subscription or a one-time lifetime purchase. The current list of Premium features and prices is shown in the App before you buy. We may add, change or remove features over time. We will not take away a paid feature during a subscription period you have already paid for without offering a fair alternative or a refund, where required by law.

5. Subscriptions, payments and cancellation

• Purchases are made through Google Play or the Apple App Store and charged to your store account. Prices include applicable taxes as shown by the store.
• Auto-renewal: monthly and yearly subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the period ends.
• How to cancel: Google Play app, Profile, Payments and subscriptions, Subscriptions; or iPhone Settings, your name, Subscriptions. Deleting the App does not cancel a subscription.
• After you cancel, Premium stays active until the end of the period you paid for.
• Lifetime purchase: a one-time payment that unlocks the Premium features included in the App for the life of the App on the store account used to buy it.
• Price changes: the store will notify you of any price change for your subscription as its rules require.
• Restore purchases: use "Restore Purchases" in the App on a new or reset device signed in to the same store account.

6. Refunds

Refunds are handled by Google Play or Apple under their refund policies. Google Play: request through play.google.com or the Play Store app. Apple: request at reportaproblem.apple.com. If you have trouble, contact us and we will help where we can. Nothing in these Terms limits any refund rights you have under consumer protection law.

7. Your data and backups

Your documents are stored only on your device and are not included in automatic device backups. If you uninstall the App, reset your device, or lose your device, documents stored in the App are lost and we cannot recover them. You are responsible for exporting and keeping copies of important documents.

8. Accuracy

Automatic edge detection, image enhancement, text recognition, business card reading and QR decoding may contain errors. The App is a tool, not a certified copy or verification service. Always check important information before relying on it. Before opening any link from a QR code, the App shows it to you so you can decide whether it is safe.

9. Third-party services

The App uses services from third parties such as Google (ML Kit, Google Play), Apple and RevenueCat. Your use of those services is also subject to their terms. We are not responsible for services we do not control.

10. Intellectual property

The App, the Docvaya name and logo, and its design and code belong to Parshva Web Solutions or its licensors. Open-source components are used under their own licences, listed in the App.

11. Disclaimer

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.

12. Limitation of liability

To the fullest extent permitted by law, Parshva Web Solutions is not liable for any indirect, incidental, special or consequential loss, or for loss of data, documents, profits or business, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

13. Termination

You may stop using the App at any time by uninstalling it. We may suspend or end your licence if you seriously break these Terms. Sections 2, 7, 11, 12 and 15 continue after termination.

14. Apple App Store users

If you downloaded the App from the Apple App Store: these Terms are between you and Parshva Web Solutions, not Apple. Apple has no obligation to provide maintenance or support for the App. If the App fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation. Apple is not responsible for any product liability, legal compliance, consumer protection or intellectual property claims about the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not in a country under a US government embargo and are not on any US government list of prohibited or restricted parties.

15. Governing law and disputes

These Terms are governed by the laws of India. Subject to any rights you have under consumer protection law in your place of residence, the courts at Goa, India have exclusive jurisdiction. Please contact us first so we can try to resolve any issue informally.

16. Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date above and, for significant changes, tell you inside the App. Continuing to use the App after changes take effect means you accept them.

ये शर्तें Docvaya मोबाइल ऐप ("ऐप") के उपयोग पर लागू होती हैं, जिसे गोवा, भारत स्थित पार्श्व वेब सॉल्यूशंस (Parshva Web Solutions) ने विकसित और प्रकाशित किया है ("हम", "हमारा")। ऐप डाउनलोड या उपयोग करके आप इन शर्तों और हमारी गोपनीयता नीति से सहमत होते हैं। यदि आप सहमत नहीं हैं, तो कृपया ऐप का उपयोग न करें।

1. ऐप उपयोग करने का लाइसेंस

हम आपको अपने स्वामित्व या नियंत्रण वाले उपकरणों पर, वैध व्यक्तिगत या व्यावसायिक उद्देश्यों के लिए, इन शर्तों और जिस स्टोर से आपने ऐप डाउनलोड किया है उसके नियमों के अनुसार, ऐप स्थापित करने और उपयोग करने का व्यक्तिगत, गैर-अनन्य, अहस्तांतरणीय और वापस लिया जा सकने वाला लाइसेंस देते हैं। जहाँ कानून स्पष्ट रूप से अनुमति न दे, वहाँ आप ऐप की प्रतिलिपि नहीं बना सकते, उसमें बदलाव नहीं कर सकते, उसकी संरचना खोलकर नकल नहीं कर सकते, और उसे दोबारा बेच या बाँट नहीं सकते।

2. आपकी सामग्री

ऐप में आप जो कुछ भी स्कैन, आयात या तैयार करते हैं ("आपकी सामग्री"), वह आपकी ही रहती है। ऐप आपकी सामग्री को आपके उपकरण पर ही संसाधित और संग्रहीत करता है, इसलिए हम उसे न प्राप्त करते हैं, न उसके स्वामी हैं और न उस पर कोई अधिकार जताते हैं। जिन दस्तावेज़ों को आप ऐप से स्कैन, कॉपी या साझा करते हैं, उनके लिए आवश्यक अधिकार होना आपकी ज़िम्मेदारी है।

3. स्वीकार्य उपयोग

आप सहमत हैं कि ऐप का उपयोग इनके लिए नहीं करेंगे:

• पहचान पत्र, प्रमाण पत्र, मुद्रा, चेक, मुहर या हस्ताक्षर की जालसाज़ी करना, उनमें बदलाव करना या उन्हें गलत रूप में प्रस्तुत करना;
• कॉपीराइट या अन्य अधिकारों का उल्लंघन करते हुए सामग्री की नकल करना या उसे बाँटना;
• बिना वैध आधार के किसी अन्य व्यक्ति के दस्तावेज़ या व्यक्तिगत डेटा स्कैन करना या साझा करना;
• आप पर लागू किसी भी कानून का उल्लंघन करना।

4. निःशुल्क और प्रीमियम सुविधाएँ

मुख्य स्कैनिंग, संपादन, पाठ पहचान, लाइब्रेरी और निर्यात की सुविधाएँ निःशुल्क हैं। कुछ सुविधाओं ("प्रीमियम") के लिए सशुल्क सदस्यता या एक बार की आजीवन खरीद आवश्यक है। प्रीमियम सुविधाओं की वर्तमान सूची और कीमतें खरीदने से पहले ऐप में दिखाई जाती हैं। हम समय-समय पर सुविधाएँ जोड़, बदल या हटा सकते हैं। जिस सदस्यता अवधि का भुगतान आप कर चुके हैं, उसके दौरान हम कोई सशुल्क सुविधा उचित विकल्प या कानून के अनुसार धनवापसी दिए बिना नहीं हटाएँगे।

5. सदस्यता, भुगतान और रद्द करना

• खरीद Google Play या Apple App Store के माध्यम से होती है और आपके स्टोर खाते से शुल्क लिया जाता है। कीमतों में स्टोर द्वारा दिखाए गए लागू कर शामिल होते हैं।
• स्वतः नवीनीकरण: मासिक और वार्षिक सदस्यता हर अवधि के अंत में उस समय की कीमत पर अपने आप नवीनीकृत होती है, जब तक आप अवधि समाप्त होने से कम से कम 24 घंटे पहले उसे रद्द नहीं करते।
• रद्द कैसे करें: Google Play ऐप में प्रोफ़ाइल, भुगतान और सदस्यताएँ, सदस्यताएँ; या आईफ़ोन की सेटिंग्स में अपना नाम, सदस्यताएँ। ऐप हटाने से सदस्यता रद्द नहीं होती।
• रद्द करने के बाद भी प्रीमियम उस अवधि के अंत तक चालू रहता है, जिसका भुगतान आप कर चुके हैं।
• आजीवन खरीद: एक बार का भुगतान, जो खरीदने वाले स्टोर खाते पर ऐप के जीवनकाल तक ऐप में शामिल प्रीमियम सुविधाएँ खोल देता है।
• कीमत में बदलाव: आपकी सदस्यता की कीमत में किसी भी बदलाव की सूचना स्टोर अपने नियमों के अनुसार देगा।
• खरीद पुनः प्राप्त करना: उसी स्टोर खाते से जुड़े नए या रीसेट किए गए उपकरण पर ऐप में "खरीद पुनः प्राप्त करें" का उपयोग करें।

6. धनवापसी

धनवापसी Google Play या Apple अपनी धनवापसी नीतियों के अनुसार करते हैं। Google Play: play.google.com या Play Store ऐप से अनुरोध करें। Apple: reportaproblem.apple.com पर अनुरोध करें। कोई कठिनाई हो तो हमसे संपर्क करें, हम यथासंभव सहायता करेंगे। ये शर्तें उपभोक्ता संरक्षण कानून के अंतर्गत आपके धनवापसी के किसी भी अधिकार को सीमित नहीं करतीं।

7. आपका डेटा और बैकअप

आपके दस्तावेज़ केवल आपके उपकरण पर रखे जाते हैं और स्वचालित उपकरण बैकअप में शामिल नहीं होते। यदि आप ऐप हटाते हैं, उपकरण रीसेट करते हैं या उपकरण खो जाता है, तो ऐप में रखे दस्तावेज़ मिट जाते हैं और हम उन्हें वापस नहीं ला सकते। महत्वपूर्ण दस्तावेज़ों को निर्यात करके उनकी प्रति रखना आपकी ज़िम्मेदारी है।

8. सटीकता

किनारों की स्वचालित पहचान, छवि सुधार, पाठ पहचान, विज़िटिंग कार्ड पढ़ना और क्यूआर कोड पढ़ना, इन सबमें त्रुटियाँ हो सकती हैं। ऐप एक साधन है, प्रमाणित प्रति या सत्यापन सेवा नहीं। किसी भी महत्वपूर्ण जानकारी पर भरोसा करने से पहले उसकी जाँच अवश्य करें। क्यूआर कोड का कोई भी लिंक खोलने से पहले ऐप उसे आपको दिखाता है, ताकि आप तय कर सकें कि वह सुरक्षित है या नहीं।

9. तृतीय-पक्ष सेवाएँ

ऐप Google (ML Kit, Google Play), Apple और RevenueCat जैसे तृतीय पक्षों की सेवाओं का उपयोग करता है। उन सेवाओं का उपयोग उनकी अपनी शर्तों के अधीन भी है। जिन सेवाओं पर हमारा नियंत्रण नहीं है, उनके लिए हम ज़िम्मेदार नहीं हैं।

10. बौद्धिक संपदा

ऐप, Docvaya का नाम और लोगो, तथा उसका डिज़ाइन और कोड पार्श्व वेब सॉल्यूशंस या उसके लाइसेंसदाताओं का है। मुक्त स्रोत (ओपन-सोर्स) घटकों का उपयोग उनके अपने लाइसेंसों के अंतर्गत होता है, जिनकी सूची ऐप में दी गई है।

11. अस्वीकरण

कानून द्वारा अनुमत पूर्ण सीमा तक, ऐप "जैसा है" और "जैसा उपलब्ध है" के आधार पर दिया जाता है, किसी भी प्रकार की स्पष्ट या निहित वारंटी के बिना, जिसमें किसी विशेष उद्देश्य के लिए उपयुक्तता और बिना रुकावट या बिना त्रुटि के चलना शामिल है।

12. दायित्व की सीमा

कानून द्वारा अनुमत पूर्ण सीमा तक, ऐप के उपयोग से होने वाली किसी भी अप्रत्यक्ष, आकस्मिक, विशेष या परिणामी हानि, या डेटा, दस्तावेज़, लाभ या व्यवसाय की हानि के लिए पार्श्व वेब सॉल्यूशंस उत्तरदायी नहीं है। ऐप से जुड़े किसी भी दावे के लिए हमारा कुल दायित्व उस राशि तक सीमित है, जो आपने दावे से पहले के 12 महीनों में ऐप के लिए हमें चुकाई है। ये शर्तें ऐसे किसी दायित्व को बाहर नहीं करतीं, जिसे कानूनन बाहर नहीं किया जा सकता।

13. समाप्ति

आप ऐप हटाकर कभी भी उसका उपयोग बंद कर सकते हैं। यदि आप इन शर्तों का गंभीर उल्लंघन करते हैं, तो हम आपका लाइसेंस निलंबित या समाप्त कर सकते हैं। खंड 2, 7, 11, 12 और 15 समाप्ति के बाद भी लागू रहते हैं।

14. Apple App Store के उपयोगकर्ता

यदि आपने ऐप Apple App Store से डाउनलोड किया है: ये शर्तें आपके और पार्श्व वेब सॉल्यूशंस के बीच हैं, Apple के साथ नहीं। ऐप के रखरखाव या सहायता का कोई दायित्व Apple पर नहीं है। यदि ऐप किसी लागू वारंटी पर खरा नहीं उतरता, तो आप Apple को सूचित कर सकते हैं और Apple खरीद मूल्य वापस कर सकता है; इसके अलावा Apple का कोई वारंटी दायित्व नहीं है। ऐप से जुड़े उत्पाद दायित्व, कानूनी अनुपालन, उपभोक्ता संरक्षण या बौद्धिक संपदा के किसी भी दावे के लिए Apple ज़िम्मेदार नहीं है। Apple और उसकी सहायक कंपनियाँ इन शर्तों की तृतीय-पक्ष लाभार्थी हैं और इन्हें आप पर लागू करवा सकती हैं। आप पुष्टि करते हैं कि आप अमेरिकी सरकार के प्रतिबंध वाले किसी देश में नहीं हैं और अमेरिकी सरकार की प्रतिबंधित या सीमित पक्षों की किसी सूची में नहीं हैं।

15. लागू कानून और विवाद

ये शर्तें भारत के कानूनों द्वारा शासित हैं। आपके निवास स्थान के उपभोक्ता संरक्षण कानून के अंतर्गत आपके अधिकारों के अधीन, गोवा, भारत के न्यायालयों को अनन्य क्षेत्राधिकार प्राप्त है। किसी भी समस्या के अनौपचारिक समाधान के लिए कृपया पहले हमसे संपर्क करें।

16. इन शर्तों में बदलाव

हम समय-समय पर इन शर्तों को अद्यतन कर सकते हैं। हम ऊपर "अंतिम अद्यतन" की तिथि बदलेंगे और महत्वपूर्ण बदलावों की सूचना ऐप में देंगे। बदलाव लागू होने के बाद ऐप का उपयोग जारी रखने का अर्थ है कि आप उन्हें स्वीकार करते हैं।
